If you have a Ford or Getrag car, you may be wondering if you can file a class-action lawsuit for a transmission defect. The good news is that you can! In this article, we’ll discuss the class action lawsuit process and the different types of settlements. Read on to learn more about the claims filed against Ford and Getrag. You may be able to save money and time by filing a lawsuit for a transmission defect.

Ford transmission defects

The company has been aware of the problems with its Ford transmissions since 2009 but has refused to issue a recall. Owners of affected cars have experienced total transmission failure. Dealers only offer temporary fixes to re-set the transmission. Ford has not commented on the lawsuit, which spans 841 pages. But the lawsuit claims that the company failed to disclose defects to customers. If your car is one of the affected models, consider filing a lawsuit.

The deadline for filing a lawsuit is fast approaching. More than 2 million Ford car owners may qualify for a $20 inconvenience payment. The total buyback amount could be up to $20,000 if you’re one of the many car owners who bought a model in the past five years. If you didn’t opt-out of the settlement, your car was automatically included. Ford also filed a motion to compel individual arbitration, which may involve different elements.

Class action lawsuits

Almost every Ford owner has been hounded by a lawsuit alleging transmission problems, and some are seeking the help of a lawyer to make sure their claims are heard. The company knows about transmission problems but has so far declined to issue a recall or offer other solutions. Instead, it has offered temporary solutions and stopped short of recalling the cars. Moreover, it has repeatedly lied to consumers about the problems, even though it knew about the defects for years. As a result, consumers have been left to fend for themselves, and the companies are fighting back.

A new Ford transmission defect class action lawsuit claims that the company was aware of the problem since the first cars were sold, and failed to disclose it or actively concealed it. Even though it released seven Technical Service Bulletins and Special Service Messages, the company has continued to keep it under wraps. Ford has been denying the problem and is imposing costly repairs for its customers. Ford has denied responsibility, and its actions have exacerbated the problem.

Getrag transmissions

In a recent court case, a group of Ford owners is suing the company for a defective transmission. The lawsuit claims that Ford has known about the defect since its introduction but has failed to disclose it. In addition, it has actively concealed the defect, issuing seven Technical Service Bulletins and Special Service Messages about the problem. Ford has only corrected three percent of affected transmissions. Ford’s failure to disclose the defect allegedly puts consumers at risk for injuries and other damages.

The MT82/MT82-D4 transmissions in the 2011-2019 Mustang have been found to have numerous problems. The transmissions in these cars are not designed to handle the higher horsepower levels of a Mustang. This is a major problem for Mustang owners, and a lawsuit is being filed as a result. This problem may also be a cause of the car’s excessive wear and tear, but the company has yet to provide a solution.

Settlements

In the Vargas v. Ford transmission defect class action lawsuit, plaintiffs are seeking nationwide settlements of $1.6 billion. The case number is C.D. Cal. 17-0579. The settlement was approved by the court on April 25, 2017, and its effective date is April 7, 2020. The case’s Final Approval Order and renewed motion for Final Approval of Settlement can be found in the case’s “Case Documents” section.

The settlement provides the class with reimbursement for clutch replacements and repairs. In addition, it also provides compulsion for the vehicle’s repair. This settlement is divided into smaller payments ranging from $20 to $2,350. The Ford settlement stipulates that the money spent by the automaker will go to the class members, and any leftovers will be distributed among the class members. The Ford Settlement also includes FAQs and a Summary of Benefits.

Cost of repairs

Although the company has been aware of the defect for years, it has steadfastly refused to issue a recall, and some owners have reported complete failure of their vehicles. Dealers, on the other hand, have offered only temporary fixes. Ford has yet to comment on the lawsuit, which spans 841 pages. Regardless of the outcome, it is important to know that consumers have a right to seek compensation for the cost of repairs and replacement parts.

A recent settlement of a federal court has made the settlement even more attractive for Ford drivers. The automaker is now obligated to pay for repairs, even if the settlement is relatively small. The company has already spent more than $47 million on buying back vehicles affected by the defective PowerShift transmission. The total buyback may be more than $20 million. The settlement does not specify how much money will be awarded to class members, but experts say the settlement is worth around $35 million.

  1. I own a 2012 Ford Mustang 5.0 and recently have found my transmission is defective. How can I get involved/included in this settlement?

    1. I own a 2014 Ford Escape, get regular motor oil changes and scheduled transmission oil/flush services. A computer error popped up “Transmission default” without fail, I felt a hard jerk as I heard and felt a terrible sound and it would not move. Called Ford and was told it will cost $6000.00 plus taxes. Is there anything that could be done on this end? Will this event be considered as apart of the lawsuit? Please advise.

  2. Does this class action suit also include the transmission issues with the Ford Focus? I have a 2015 Ford Focus that shutters and stammers and shifts very lethargic. I have been told that there is no problem, that the transmission is trying to learn the driving habits of the driver. (Really)? Any information you provide may be helpful.

  3. My 2013 Ford Escape transmission (only 35,000 miles) has now failed twice. I will not repair for the second failure. Do I have recourse in this situation?

  4. Does this color a 2012 ford focus? I got it fixed wants replaced an actuary Now they say I need Transmission control module. And it’s going to cost me $1,400. Also they are telling me that the part I need is on back order for a year now.

  5. I own a 2018 Ford F-150 with the 10-speed automatic transmission, first the dealership told me “It’s the transmission learning my driving habits” (after 3 years) and I needed a new battery to reprogram the computer. $272.00 later & still the same problem. I haven’t had my truck since 8/16/22 but yet I’m forced to pay my payment & my insurance for a vehicle that I can’t use. I was loaned a Ford Edge, I’m a farm girl, trust me when I say “you can’t fit a 750lb round bale of hay in it” so I’m forced to pay delivery fees. And I’m inconvenienced because if any of my animals get injured, I’m not allowed to take them to the vet in the loaner.

  6. I own a 2017 Ford Fiesta and found out the TCM unit is defective. How do I go about entering the class action against Ford and am I eligible to do so?

  7. HAVE A 2016 FORD ESCAPE TRANSMISSION PUMP FAILURE. SEEN NUMEROUS COMPLAINTS OF PUMP SHAFT BREAKING.. LEAVING CAR STRANED IN MIDDLE OF ROAD.. ARE THERE ANY LAWSUITS GOING ON THIS PROBLEM.

  8. I have a 2017 ford mustang with the MT82 transmission and my 4th gear synchronizer is going out with less than 18,000 miles can i still get in the lawsuit

  9. Why is nobody talking about the Ford freestyles? Over 60% of all the transmissions failed in these cars and Ford did nothing to help anybody. Ford knew about all these problems and yet most people either had to junk their car or spend $5000 for a new transmission. I still have my 2006 and now I’m working on the third transmission. But because Ford has decided not to support this transmission anymore parts are becoming very very hard to find to repair. It makes me very frustrated and angry that I have a perfectly good car that is now partly not gonna be able to work anymore because of a few dollars worth of parts in the transmission.
