The In Re Debtor Richard P. Herman case was filed in the U.S. District Court for the Northern District of Illinois in June 2010. Herman’s bankruptcy attorney filed schedules of creditors. Miller’s primary appeal concerns the lack of notice. The case focuses on the failure to give notice to Miller of his discharge. Without notice, Miller would not have taken any actions to protect his rights before the discharge order. The bankruptcy code contains an exemption for creditors who fail to provide sufficient notice of their rights. The case could also result in Miller being denied discharge of his debts.
The debtors and creditors in this case are the Three Park Avenue Building Co., Richard P. Herman, and The Seavey Organization. Herman was appointed trustee on March 16, 1999. On August 14, 1998, the trustee filed an adversary proceeding to collect the remaining proceeds of the letter of credit. Richard Herman, P.C., was named as a defendant in the complaint.
